Findlay is an experienced litigator with a focus on regulatory investigation and prosecution. He has particular experience in professional disciplinary matters, investigations and inquiries.
Findlay has appeared as counsel in all courts in New Zealand and some specialist tribunals. He regularly appears in the Health Practitioners Disciplinary Tribunal and has acted for practitioners and Professional Conduct Committees.
Before joining LCC Findlay was in the Criminal Team at the Crown Law Office working in criminal appeals and extradition. He then spent time in civil litigation teams at two large law firms. Mostly recently he was a senior legal adviser at a health practitioner regulator.
Recent and notable work:
Representing Professional Conduct Committees and practitioners in investigation and prosecution of allegations of serious professional misconduct (including sexual and physical assault on patients, misinformation and theft from patients).
Representing a practitioner in six-day coronial inquest relating to mental health compulsory treatment framework.
Representing Attorney-General in three-week civil trial involving duty of care in aviation context (Dovey Aviation v Attorney-General [2021] NZHC 429).
Representing Open Country Dairy in application for judicial review of Commerce Commission pricing calculation matter (Open Country Dairy v Commerce Commission [2020] NZHC 334).
Representing the United States in United States v Dotcom extradition proceedings, including 12-week eligibility hearing and four-week High Court appeal.
Representing the Crown in two substantive Supreme Court criminal appeals (Taniwha v R [2016] NZSC 123, [2017] 1 NZLR 116, Dixon v R [2015] NZSC 147, [2016] 1 NZLR 116).
